1. Introduction
Welcome to Property Lounge, a South African property marketplace platform that connects sellers, landlords, estate agents, and private individuals (“Vendors”) with buyers and tenants (“Browsers”).
By accessing or using our website, you agree to these Terms and Conditions, our Privacy Policy, and any other notices posted on the site.
If you do not agree, please do not use the platform.
2. Definitions
- “Property Lounge”, “we”, “our”, “us” – refers to Property Lounge (Pty) Ltd.
- “Vendor” – means any agent, agency, landlord, or private seller listing a property on our platform.
- “Browser” – means any person viewing or responding to listings on the Property Lounge website.
- “Listing” – means any property advert placed by a Vendor.
- “User” – means both Vendors and Browsers collectively.
3. Service Overview
Property Lounge provides:
- A platform for Vendors to create, manage, and promote property listings; and
- A viewing and enquiry tool for Browsers to explore properties listed by Vendors.
Property Lounge does not act as an estate agent, broker, or property representative. All transactions and communications between Vendors and Browsers occur directly between the parties.
4. User Accounts
4.1. Registration
Users must create an account to list or interact with listings. You agree to provide accurate, current, and complete information.
4.2. Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
4.3. Account Termination
Property Lounge reserves the right to suspend or terminate any account found in violation of these Terms or any applicable law.
5. Vendor Obligations
By listing a property, Vendors agree to the following:
5.1. Accuracy
All property details, descriptions, prices, and media uploaded must be truthful, accurate, and not misleading.
5.2. Ownership & Authority
You must have full legal authority to market and advertise the listed property.
5.3. Listing Fees
Vendors agree to pay applicable fees for Standard or Featured Listings as displayed on the Property Lounge website. All fees are non-refundable once the listing is live, as per our Refund & Returns Policy.
5.4. Compliance
Vendors must comply with South African property, marketing, and consumer protection laws, including but not limited to the Estate Agency Affairs Act and the Consumer Protection Act (CPA).
5.5. Content Rights
By uploading content (photos, videos, text), you grant Property Lounge a non-exclusive right to display and promote such content on our platform and associated marketing channels.
6. Browser Obligations
Browsers agree to:
- Use the platform lawfully and only for viewing legitimate property listings.
- Not use automated systems (bots, scrapers) to extract or copy listing data.
- Understand that Property Lounge is not responsible for the accuracy of listings and that any property purchase or lease is made at your own discretion.
7. Payments and Fees
- Listing fees must be paid in full prior to publishing.
- Payments are processed through our secure payment gateway (e.g., PayFast).
- Property Lounge does not handle deposits, rental payments, or property purchase funds between Vendors and Browsers.
8. Affiliate Program
Affiliates who promote listing services through Property Lounge’s affiliate system agree to the Affiliate Terms, including commission structures and payout timelines as outlined on the website.
Property Lounge reserves the right to adjust commission rates or terminate participation for misuse, fraud, or breach of terms.
9. Prohibited Activities
Users may not:
- Post fraudulent, misleading, or duplicate listings.
- Upload offensive, discriminatory, or unlawful content.
- Misrepresent their identity or relationship to a property.
- Attempt to breach, hack, or misuse the Property Lounge website.
Any violation may result in immediate suspension or permanent account termination.
10. Intellectual Property
All content, software, logos, graphics, and design elements on the Property Lounge platform are owned by or licensed to Property Lounge.
You may not copy, distribute, modify, or reproduce any part of the site without written consent.
11. Disclaimer of Warranties
Property Lounge provides the platform “as is” and makes no guarantees regarding:
- The accuracy of listings,
- The availability or condition of properties, or
- The conduct of users.
We are not responsible for losses or damages resulting from your use of or reliance on information from this platform.
12. Limitation of Liability
To the fullest extent permitted by South African law, Property Lounge shall not be liable for any direct, indirect, or consequential damages arising from:
- Use of the website,
- Any property transactions between Vendors and Browsers,
- Or unauthorised access to user data.
13. Indemnification
Users agree to indemnify and hold harmless Property Lounge, its directors, staff, and affiliates from any claim, damage, or loss resulting from their use of the platform, breach of these Terms, or violation of applicable laws.
14. Privacy
Your personal information is protected in accordance with the Protection of Personal Information Act (POPIA).

15. Termination
We may suspend or terminate any user account at our discretion if we believe it violates these Terms or the law.
Upon termination, all access rights and any remaining listings may be removed.
16. Amendments
Property Lounge reserves the right to modify these Terms at any time. Updated versions will be posted on this page with a revised effective date. Continued use of the site constitutes acceptance of the new Terms.
17. Governing Law
These Terms are governed by the laws of the Republic of South Africa.
Any disputes shall be subject to the jurisdiction of the High Court of South Africa (Gauteng Division).
